Service overview

Copyright registration records information concerning an eligible copyright work under the Copyright Ordinance, 1962.

Trademark, copyright, patent and design rights have distinct subsistence, filing, examination, opposition and renewal rules. Filing one form of right does not automatically protect every aspect of a product or brand.

02

Who is eligible to register a copyright claim?

Statutory eligibility

Authors, publishers or owners/interested persons may apply where statutory conditions are met; copyright subsistence is not automatically dependent on registration.

Conditions and exclusions for this application

Copyright belongs to an eligible author or owner of an original protected work under the statutory law. Registration records the claim but does not alone create copyright where the work is ineligible.

03

Documents and information for Copyright Registration

Prepare the following information for copyright registration. The relevant regulator may require further forms or certified evidence, depending on the applicant and chosen procedure.

  • Work copy or identification
  • Author and claimant details
  • Creation/publication dates
  • Chain-of-title documents
  • Required declaration and category information.

How do I register copyright in Pakistan? — step-by-step guide

  1. 01
Identify the appropriate application route and eligibility

First determine whether the proposed applicant and activity fall within this procedure. Authors, publishers or owners/interested persons may apply where statutory conditions are met; copyright subsistence is not automatically dependent on registration. Review the separate conditions and exclusions in the eligibility section before submitting any form or payment.

  2. 02
Prepare the application documents and evidence

Start with the particulars listed for this service: Work copy or identification; Author and claimant details; Creation/publication dates; Chain-of-title documents; Required declaration and category information.. Ensure the names, applicant identity and documents are consistent. The authority may require further supporting material under its current checklist.

  3. 03
Check the current regulator instructions before filing

Refer to the regulator resource identified on this page (IPO Pakistan statutory registry ↗). Reconfirm the currently prescribed forms, online or physical submission method, supporting evidence, fee and any current amendments. Do not assume that historic processing times or fees remain applicable.

  4. 04
    Determine copyright work and claimant

Classify literary, artistic, musical, software or other works and the chain of authorship or employer/contractor assignment.

  5. 05
Prepare registration statements and a work deposit

Supply the prescribed particulars, claimant and author identities, creation/publication details and a suitable work copy.

  6. 06
    Submit to Copyright Registrar

File through the current IPO-Pakistan copyright registration procedure and comply with the required objection/publication process where applicable.

  7. 07

  8. 08
Keep the approval record and track ongoing obligations

After the authority has made its decision, retain the acknowledgement, correspondence, evidence of approval and any conditions attached to it. Maintain original source files, assignment evidence and ownership records; monitor infringements. Check whether separate approvals, renewals or reporting duties apply to the actual business.

Before you submit: application file check

Use the current regulator checklist to confirm that every listed item is still required and that any activity-specific conditions have been met. The items below are drawn from the document requirements identified on this page, not a representation that the checklist is exhaustive.

  • Work copy or identification

Copyright registration: evidence of authorship and section 39 entry

Primary-source research note. The following procedural analysis is based on the identified government or regulator sources. Confirm enacted amendments, applicable forms, fees and filing requirements on the date of submission. A consultation draft is not operative law merely because it has been published. This note does not represent final legal-editor certification of the entire guide.

Copyright subsistence versus registration

Under the Copyright Ordinance, 1962, protected literary, artistic, musical and other defined works may attract copyright through the statutory framework without treating registry entry as the event creating the right. Section 39 permits the author, publisher, owner or other person interested to seek an entry in the Register of Copyrights. A company-registration certificate is not evidence that the company owns a software program, artwork or creative work.

Establish the first owner

Section 13 and the relevant agreements govern first ownership, including different rules for commissioned works, employment and government work. Before filing, obtain the work, author identity, date of creation or publication, employee or contractor agreement and any assignment chain. Protect confidential source code and trade secrets when deciding what evidence to disclose.

Application and artistic-work publication

Section 39 contemplates the prescribed form and fee. For certain artistic works the statutory proviso requires newspaper advertisement of the work and permits objections within its stated procedure before registration. Examine the Copyright Rules, 1967 for the current form and notice details; do not incorrectly apply the artistic-work advertisement requirement to every copyright category.

Registry decision and evidentiary use

Retain the application, copyright copy or identifying particulars, documentary ownership chain, any advertisement and objections, and the certificate if granted. Registration may support proof but does not resolve every question of original authorship, infringement or contractual ownership. Check statutory term and permitted use separately.

How Chambers can assist

Chambers can review the legal route, identify regulatory constraints, prepare or review the supporting corporate and legal documents, manage the prescribed submission and correspond with the competent authority where instructed. The scope of the engagement will be determined by the applicant’s particular circumstances.
