What the matter
actually requires.
When a public authority exceeds its powers, fails to follow mandatory procedure or reaches a decision on an unlawful basis, the first question is which defect the court can correct.
We advise on constitutional petitions, judicial review, regulatory action and statutory interpretation. We distinguish the merits of a decision from the legality of the process through which it was made, and we frame relief accordingly.
Timing, alternate remedies, maintainability and the official record may decide the case before its substantive merits are reached. These questions are addressed at the start.
Was public power exercised lawfully, and what relief is available?
