Service overview
Promotion of an area as an SEZ is a governmental notification process supported by a development proposal; a private business cannot simply self-designate its land an SEZ.
SEZ, STZA and EPZA permissions involve different regulators, zones and tax rules; obtaining one status never substitutes for another.
Who qualifies for Special Economic Zone Developer and Zone Approval?
A public, private or public-private proponent must have legally viable land and an infrastructure development proposal capable of meeting statutory zone-approval criteria.
SEZ status is conferred by governmental approval/notification and may be subject to current intake policies; neither land title nor company incorporation is enough.

SEZ developer and zone notification: BOI, BOA and provincial authority roles
Primary-source research. The following procedural analysis is based on the identified government or regulator sources. Confirm enacted amendments, applicable forms, fees and filing requirements on the date of submission. A consultation draft is not operative law merely because it has been published. This note does not represent final legal-editor certification of the entire guide.
Development approval is different from enterprise admission
The SEZ Act, 2012 and Rules, 2013 create pathways for state, public-private and private-sector development of a notified zone. Developer status and development agreement concern infrastructure and operation, while individual Zone Enterprise entry is a separate approval. The BOI acts as secretariat to the Board of Approvals and the relevant Approvals Committee, with roles also for the relevant SEZ Authority.
Qualify land and project concept
BOI's SEZ framework describes a general minimum land requirement of 50 acres for an ordinary zone, subject to separate types of SEZ and operative exceptions. Gather site title and encumbrance report, legal access, zoning, water, power and gas availability, environmental assessment, investment and tenant demand, master plan, financing and staged infrastructure. A development-zone proposal and its approved status cannot be inferred from the applicant's purchase of industrial land.
Apply through competent institutions
Prepare developer shareholding, investment and financing commitments, schedule, concession agreement for public-private structures, proposed Zone Regulations and master plan. Submit to the relevant SEZ authority and follow BOI/committee approval and federal notification requirements. The amended 2026 Act affects institutional competence, rights under concession and development agreements, and remedies for developer non-performance.
Development agreement and ongoing risk
Record infrastructure performance, lease terms, Zone Enterprise admissions, investment density, inspections, environmental/safety obligations and financial incentive conditions. Section 22 as amended addresses sanctions and possible cancellation after notice/hearing for development breaches. A developer agreement does not provide blanket exemption from building, energy, environmental or labour approvals.
