Energy investments involve long asset lives, regulated prices and permissions that may change after capital has been committed. The central legal issue is not whether regulatory change is possible—it is how its consequences have been allocated among sponsors, buyers, contractors, lenders and public.
An energy supply agreement can promise payment for years yet leave the supplier exposed to a single unpaid billing cycle if the buyer's credit is weak. Payment security, settlement mechanisms and termination rights are therefore integral to the project's financial viability rather than secondary commercial.
Energy projects often fail to meet planned completion dates for reasons that cross the boundaries between engineering, public permissions and contractual administration. A delay caused by a design change may affect grid connection, equipment delivery and commissioning. Responsibility cannot be established.
