Overview of the Case
Labour revision was preferred under Section 51(4) of the Khyber Pakhtunkhwa Industrial Relations Act 2010 by a rival trade union challenging a Labour Court order that dismissed its objection to the Office-Bearers Certificate of respondent No.2. Consequently, the Labour Revision was dismissed.

Brief Facts
The Registrar of Trade Unions issued an office-bearers certificate dated 16 February 2026 in favour of the Mazdoor Ittehad Municipal Workers Union. The rival United Municipal Workers Union objected to the inclusion of Syed Qaiser Ali Shah among its office-bearers under the outsider quota, pointing to his BPS-17 position. The rival union maintained that he held a supervisory or managerial status, while the respondents said he continued performing technical duties despite the upgraded scale. The Labour Court dismissed the challenge on 20 April 2026, and the objecting union filed a labour revision.

The Court's Answers
Whether a rival trade union operating within the same collective bargaining unit has locus standi to challenge an Office-Bearers Certificate issued to a competing union under Section 9(7) of the Khyber Pakhtunkhwa Industrial Relations Act 2010?
Answer. Yes. A rival union in the same bargaining unit has sufficient interest to challenge an office-bearers certificate under the relevant provision.
“The petitioner may, therefore, be regarded as an aggrieved trade union within the meaning of section 9(7)”
Whether an individual inducted as an office-bearer under the 25% outsider quota of a trade union executive is statutorily required to be a worker or workman under the Khyber Pakhtunkhwa Industrial Relations Act 2010?
Answer. No. The statute does not impose that additional qualification on office-bearers appointed under the outsider quota.
“Section 6 of the IRA 2010 does not prescribe any qualification or restriction requiring a person inducted against the twenty-five per cent outsiders’ quota to fall within the statutory definition of a worker or workman.”

Practical Relevance
Union officials and employers should apply the eligibility criteria actually stated in the industrial relations statute. Challenges to certificates must distinguish standing to object from the substantive grounds for invalidation.
