Overview of the Case

This Regular First Appeal arises from a judgment and decree passed by the Banking Court, which dismissed the appellant-bank's recovery suit to the extent of the legal heirs of a deceased mortgagor, Bashir Ahmad. The court laid down the principle that the death of a mortgagor or the unenforceability of subsequent renewal documents against legal heirs in a personal capacity does not discharge or extinguish a mortgage validly created during the lifetime of the mortgagor, and the mortgaged property remains subject to the subsisting mortgage.

Brief Facts

MCB Bank provided finance facilities to S.N. Enterprises and its proprietor, Suhail Nazar. In March 2004, Bashir Ahmad mortgaged a plot in Model Town-A, Bahawalpur, through a registered deed as security for the borrowing. Bashir Ahmad later died, and the finance documents were renewed in July 2008 without fresh disbursement. When MCB pursued recovery, the heirs disputed whether documents executed after Bashir Ahmad's death could impose or extend liability upon him or them. The Banking Court decreed part of the bank's claim against the other defendants but dismissed it against the heirs in respect of the mortgaged security.

The Court's Answers

QUESTION 1

Does the death of a mortgagor extinguish a mortgage validly created during their lifetime?

Answer. No. A lawfully created mortgage remains enforceable against the secured property.

IN THE COURT'S WORDS

“The absence of personal liability on the part of the legal heirs does not, by itself, operate to discharge or extinguish the subsisting mortgage created by their predecessor during his lifetime.”

Judgment, paragraph 9
QUESTION 2

Can legal heirs be held personally liable for finance documents executed after the death of the mortgagor?

Answer. Not merely because later financing documents were executed after the predecessor's death; personal liability must be independently established.

IN THE COURT'S WORDS

“Consequently, the legal heirs of Bashir Ahmad cannot be held personally liable for the outstanding amount merely on the basis of the subsequent renewal documents.”

Judgment, paragraph 10

Practical Relevance

Banks should distinguish enforceable security over inherited property from personal claims against heirs. Inheritance advisers should examine mortgages registered during a deceased owner's lifetime before representing the estate as unencumbered.
