A taxpayer challenging a Pakistani sales tax demand should assemble documents proving the actual nature, value and tax treatment of the disputed supplies, purchases or services. The correct evidence and appeal route depend on whether the demand arises under the federal Sales Tax Act, 1990 or a provincial sales tax on services law. A demand based on alleged undeclared sales, inadmissible input tax, wrong classification or fraudulent invoices calls for different proof. The starting point is the exact show-cause notice or final order and its statutory basis, rather than a general assertion that the department's demand is excessive.
Obtain the complete demand record
Retain the show-cause notice, audit observations, annexures, hearing notices, original replies and signed assessment order. Check the tax periods and relevant provisions cited. A notice proposing liability is not necessarily a final appealable assessment. The taxpayer should distinguish a tax demand from interest, default surcharge and penalty and identify the officer's stated reasons for each. Missing annexures should be requested promptly because they can reveal the underlying transaction data.
Identify the tax jurisdiction
Federal sales tax on goods is regulated under the Sales Tax Act, 1990, while services can fall under laws administered by provincial revenue authorities, depending on the transaction and constitutional allocation. Sindh, Punjab, KP and Balochistan service-tax regimes have distinct statutes and procedures. The taxpayer should not file a federal appeal merely because both demands are called sales tax. Mixed contracts, imported services and interprovincial supplies can require careful classification.
Reconcile sales tax returns
Collect the returns submitted for each tax period and compare declared supplies with the audited accounts, general ledger, customer records and bank receipts. Explain timing differences, credit notes, advances, sales returns and receipts that are not consideration for taxable supplies. The existence of a bank deposit does not automatically prove a taxable sale. A reconciliation should identify every material difference rather than submit only annual turnover totals.
Sales invoices and supply records
Retain tax invoices, purchase orders, delivery challans, goods-dispatch records, customer acknowledgments and contracts. These documents can establish when a taxable supply occurred, what goods or services were involved and the relevant taxable value. If the department alleges suppression of sales, contemporaneous delivery and inventory records can be decisive. A taxpayer should not manufacture invoices after receipt of a notice or backdate documents to reconcile a disputed period.
Input tax adjustment
Where the demand disallows input tax, identify the exact purchases and applicable statutory conditions. Collect supplier invoices, supplier tax registration details, payment evidence, goods receipts and evidence linking purchases to taxable business activity. Section 8 and other relevant provisions of the federal Act can restrict input adjustment in defined circumstances. A tax invoice alone does not necessarily cure every legal disqualification, while an unexplained blanket disallowance may be contestable.
Supplier compliance questions
Input tax disputes sometimes concern supplier non-filing, suspension or alleged fake invoices. The recipient should obtain records showing the actual transaction, supplier identity and payment, while assessing any statutory condition concerning system validation or tax deposit. The taxpayer's evidence of genuine supply can matter, but the specific applicable law and judicial interpretation govern the result. An invoice shown as active in the system is not always sufficient to prove actual delivery.
Bank and payment records
Bank statements, payment instructions, cheque copies and official tax challans can demonstrate that the transaction occurred and was settled. Trace a disputed invoice through purchase order, delivery, accounting and bank payment. Cash transactions may be subject to separate statutory restrictions and evidentiary problems. Where one bank payment covers multiple invoices, prepare an allocation schedule with underlying remittance information. An unexplained spreadsheet total is weaker than reconciled source records.
Classification disputes
A demand may turn on whether an item is an exempt supply, zero-rated item, taxable good or service. Obtain product specifications, tariff or classification codes, contracts and relevant notifications. A manufacturer should not rely solely on the description printed on an invoice if the actual product differs. The rate and exemption treatment must reflect the law operative in the specific tax period. Subsequent statutory changes are not automatically retroactive.
Taxable value and discounts
The department may allege undervaluation or improper exclusion of freight, discounts or related payments. The contract, invoice, delivery terms and accounting records should explain the actual consideration. Related-party transactions can require additional scrutiny. The taxpayer should identify whether a price adjustment followed a genuine credit note and whether prescribed formalities were satisfied. Disputes concerning valuation should be separated from those concerning classification or taxable status.
Stock and production evidence
In manufacturing cases, the authorities may infer undeclared supplies from raw material consumption, electricity use or production capacity. Obtain stock registers, yield reports, wastage records, engineering reports and production logs. Such evidence can test whether the estimate is technically and factually sustainable. An industry-average yield is not necessarily decisive where the plant's actual technology and operating conditions differ, but unsupported company assertions will not suffice either.
Audit objections and hearing rights
Determine whether the officer relied on a lawful audit, investigation or assessment provision and gave the hearing prescribed by statute. Section 11 and related federal provisions may apply depending on the period and amendments. The taxpayer should request the material used in quantifying liability and answer each allegation. A procedural challenge should identify the violated requirement and resulting prejudice, not simply assert that every audit demand violates natural justice.
Appeals under the current law
The federal appeal structure has been amended over time, including treatment of orders at different monetary thresholds. The taxpayer must use the Sales Tax Act as amended through 30 June 2026 and identify whether the appeal lies to the Commissioner (Appeals) or another forum at the relevant stage. It would be unsafe to rely on a 2023 statement of a universal appeal route. File within the statutory period with required documentation and any stay request separately.
Rectification is not a substitute for appeal
An obvious arithmetic or record error may be susceptible to statutory rectification, but a disputed interpretation of an exemption or conflicting evidence usually requires a substantive challenge. A rectification application should identify the apparent mistake exactly. It should not be assumed to suspend appeal limitation unless law expressly provides that result. Preserve both the application date and the underlying assessment order.
Recovery and interim protection
An assessment can trigger tax recovery measures under the applicable statute. Filing an appeal may not automatically stay the entire demand. Determine the competent authority's power to suspend recovery and the conditions for relief. Where amounts are admitted in part, separate undisputed and disputed sums. A business should not ignore bank attachment or other enforcement notices merely because counsel is preparing detailed submissions.
Example: omitted turnover allegation
A distributor declares Rs. 80 million in sales, while the department treats Rs. 95 million of bank deposits as taxable turnover. The company should identify loan receipts, inter-account transfers, tax-inclusive receipts and actual supply invoices. A reconciliation can show whether the department double-counted collections. The substantive case should explain every disputed receipt rather than merely present audited turnover as conclusively correct.
Example: input tax refusal
A factory claims input tax on machinery components and production materials, but the authority disallows the credit citing defective supplier records. The factory should supply purchase contracts, genuine delivery evidence, invoices, bank transfers and tax declarations, then address the exact statutory disqualification. The legal result depends on the operative input tax conditions and supporting proof, not a general statement that the factory acted in good faith.
Evidence index and appeal preparation
Prepare a paginated document bundle organised by tax period and allegation. Include a transaction reconciliation, key statutory provisions, notices, hearing record and correspondence. Each appeal ground should cite relevant evidence and relief sought. The taxpayer should preserve original electronic records and avoid inconsistent numbers between audit replies and appeal pleadings. Clear documentation can allow the tribunal to focus on genuine legal disputes rather than accounting uncertainty.
Opinion and recommended course
A defensible challenge to sales tax requires the actual assessment and comprehensive transaction records: returns, invoices, contracts, delivery evidence, bank payments, ledger reconciliations and tax challans. Select the federal or provincial appeal regime correctly, meet limitation and address recovery separately. The strongest case connects each contested rupee to a particular document and legal provision.
