Service overview

VASP compliance includes class-specific prudential, AML/CFT, market conduct and reporting duties.

PVARA differentiates the initial NOC, incorporation in Pakistan, and final licensing for one or more authorised services. An NOC is not an operating licence, and each chosen licence class has its own safeguarding, capital, competence and activity rules.

02

Who is eligible for VASP Continuing Regulatory Compliance and Reporting?

Statutory eligibility

The actual licence category determines applicable capital, reporting, governance, custody and technology obligations.

Conditions and exclusions for this application

Only a licenced VASP in the relevant category should use its associated continuing compliance regime, with paid-up capital and reporting obligations assessed by every authorised class.

For VASP licences, paid-up capital, eligible company form, director qualifications and actual regulated activity must be tested separately for the chosen licence class. A PVARA NOC does not grant permission to operate.

PVARA continuing compliance: licence categories, client safeguarding and supervisory returns

Primary-source research. The following procedural analysis is based on the identified government or regulator sources. Confirm enacted amendments, applicable forms, fees and filing requirements on the date of submission. A consultation draft is not operative law merely because it has been published. This note does not represent final legal-editor certification of the entire guide.

The live licence, not a pending NOC, governs operations

A PVARA VASP must perform only the activities included in its final Category-specific licence under the Virtual Assets Act, 2026 and notified Virtual Asset Services Regulations, 2026. Broker-dealer, exchange, custody, lending, derivatives and token issuance carry materially different capital and operational obligations. A NOC or successful sandbox test is not itself a commercial licence.

Maintain a category-specific obligations register

Identify paid-up capital, qualifying shareholders and directors, compliance personnel, customer onboarding, beneficial ownership, virtual-asset safeguarding, cybersecurity and other continuing obligations from the actual licence and Activity Specific Regulations. Transactions involving custody, lending of client assets or market-making should be reconciled to the precise approved categories and legal terms.

Financial crime and transaction controls

Maintain risk-based AML/CFT/CPF policies, customer due diligence, screening, transaction and wallet monitoring, suspicious-activity escalation, audit trails, cyber incident logging and complaint resolution. Different token and customer profiles require different controls; generic onboarding forms do not prove live regulatory readiness. Keep verifiable reconciliation between customer liabilities and controlled on-chain assets.

Report changes and avoid unsupported fixed deadlines

Assess prior approval or notification for new controllers, directors, substantial capital changes, licensed activities, outsourcing and winding down. Prepare statutory/financial returns and incident reports using the current PVARA instructions. Do not quote a uniform filing cycle or presume a consultation draft has altered the operative rules without a final notification.
