An arbitral award made abroad may determine the merits of a commercial dispute yet still require recognition and enforcement before assets in Pakistan can be reached. The enforcing court's task is not ordinarily to conduct a fresh trial. The applicable statutory grounds and documentary requirements are therefore critical.
The foreign award must be identified legally
The Recognition and Enforcement (Arbitration Agreements and Foreign Arbitral Awards) Act, 2011 gives effect to obligations concerning foreign arbitral awards within its scope. Whether an award qualifies depends on its juridical character and the relevant statutory and treaty framework. An award is not 'foreign' merely because a hearing occurred outside Pakistan or the contract involved overseas parties. Counsel should verify the seat, operative arbitration agreement, applicable rules and award status before selecting the enforcement route.
The application begins with documents
A party seeking recognition should obtain the authenticated award, arbitration agreement and any translations or formalities required by the applicable law and court rules. The award creditor should establish who is bound, the sums awarded and the relevant debtor's assets. Defects in names, corporate identity, calculation or proof of authenticity can delay enforcement even where the underlying entitlement is strong. Where the award provides interest or costs, the calculation should be transparent and tied to the operative award rather than an unparticularised demand.
Defences are limited, not nonexistent
Under the New York Convention framework, the resisting party may raise specified grounds relating to matters such as the validity of the arbitration agreement, notice and opportunity to present its case, scope of submission, composition of the tribunal, status of the award, arbitrability or public policy. Those grounds must be established by reference to the statutory test. A general assertion that the tribunal misunderstood evidence or awarded excessive damages is not a licence for the enforcement court to hear the case anew. The precise public-policy standard requires careful examination of applicable Pakistani authority rather than broad appeals to unfairness.
Enforcement planning begins before the award
The creditor should consider where the respondent holds assets, whether there are prior security interests and whether parallel proceedings may complicate recovery. The contractual choice of arbitration seat and service procedure can affect the ease of later recognition. A debtor who genuinely contests enforcement should focus on an available statutory ground and supporting record rather than recycling submissions rejected by the tribunal. Parties may settle after an award, but any agreement should address release, interest, security and the consequences of default to avoid another enforcement dispute.
The award is not the recovery
Foreign award enforcement is principally a statutory process with a defined range of objections. Counsel should prepare the evidence of the award and the route to attachable assets before filing. The strengths and limitations of that process should also inform the arbitration clause at the start of the commercial relationship.
